| Full Terms and Conditions |
| - Information on how to enter and prizes form part of the Terms and Conditions of entry. Participation in the Marillion Weekend VIP Passes Contest implies acceptance of the Terms and Conditions of entry. |
| - To enter the contest listed above, participants must submit 1 or more photos of themselves wearing or displaying any official Marillion merchandise or the band's name, logo, or other album artwork prominently displayed in digital format by email to photos@marillionweekend.com in JPEG format with a file size of less than 1 Megabyte. We WILL NOT ACCEPT posted or faxed submissions. |
| - More than one image may be submitted by an individual. |
| - Submitted images should avoid containing copyrighted or trademarked material, and must not contain offensive or illegal images. |
| - By submitting an entry, entrant is explicitly agreeing to the following media release for any individuals included in the submitted image: "I hereby give permission to Marillion / Intact Records / Racket Records to use the image provided, my name, likeness and biography for the purposes of Marillion / Intact Records / Racket Records promotional material and publications (including, but not limited to, television broadcast or synchronisation, website or other online or digital distribution, print
media) and waive any rights of compensation or ownership thereto in perpetuity. I warrant and represent that all material furnished by me is my own or for which I have full authority for such purposes." |
| - Entries must be receied by the contest closing date of midnight GMT on 31 January 2009 |
| - A minimum of one (1) winner will be chosen to receive two (2) VIP passes, allowing entry into sound checks, designated backstage areas, and possible other exclusive events. Winners choosing the Marillion Weekend 2009: Netherlands will receive accommodation tickets as part of the prize. Winners choosing the Marillion Weekend 2009: Canada will receive free passes to all shows as part of their prize. Pass holders will be required to follow all instructions of Marillion and/or their employees or agents during the event. |
| - Final selections will be made by Marillion and/or their employees or agents. No financial compensation will be provided for use OR non-use of any submission. Marillion/Racket Records' decision is final and no correspondence will be entered into. |
| - The winner will be contacted by return email to the address used to submit the photo(s). |
| - Marillion/Racket Records shall not be liable if, for any reason outside its control, any part of the chosen prize package becomes unavailable. |
| - Marillion/Racket Records shall not be responsible for any travel or other expenses in association with any prizes offered, except where otherwise indicated. It is the responsibility of the participant to arrange for travel to and from the chosen Marillion Weekend |
| - Marillion/Racket Records takes no responsibility for incomplete, illegible, lost, misdirected or late entries. |
| - If Marillion/Racket Records is unable to contact the winner within a period of 2 weeks following the selection date, having made reasonable efforts to do so, Marillion/Racket Records reserves the right in its absolute discretion to re-draw from the remaining entries and select another winning participant. |
| - Marillion/Racket Records reserves the right to verify the validity of all entries. Marillion/Racket Records reserves the right to disqualify any entrant for tampering with the entry process or attempting to act in a fraudulent or otherwise dishonest manner. |
| - Marillion/Racket Records shall not be liable for any loss or damage suffered (including but not limited to indirect or consequential loss), or for any injury suffered or sustained or liability or costs incurred, as a result of accepting or using any prize, except for any liability that cannot be excluded by law. Marillion/Racket Records is not liable for any tax implications that may arise as a result of winning any prize. Prize values are given as at the commencement date of the promotions. |
| - Marillion/Racket Records reserves the right to substitute any of the prizes with that of similar value at any time without prior notice and all prizes are non transferable or exchangeable. |
| - Marillion/Racket Records will hold and may use personal information accompanying any entries for purposes relating to the promotion and for sending entrants promotional and other material in relation to future offers, information and activities of the Promoter, unless otherwise advised by the entrant at the time of entry. All entrants have the right to inspect and update their personal information at any time. |
| - Winners agree to be available for reasonable publicity purposes without compensation including, but not limited to, photographs and interviews. Copyright will vest in Marillion/Racket Records. Winners acknowledge that their personal details may be published in print media and on the internet. |
